The terms on which you may use SandeshWA.

1. About these terms

SandeshWA is a software platform that helps businesses manage contacts, message templates and messages on the WhatsApp Business Platform, and track delivery. These terms are an agreement between you and the business named in the "Who we are" box on this page ("we", "us"). By creating an account or using SandeshWA you accept them. If you do not accept them, do not use the service.

2. Who can use it

  • The service is for businesses and professionals, not for personal or household use.
  • You must be at least 18 years old and able to enter a binding contract, and if you sign up for a company you confirm you have authority to bind it.
  • You must give accurate information when you register, and keep it up to date.

3. Your account

  • You are responsible for everything done under your account and for keeping your password secure. Tell us at once if you think it has been misused.
  • You choose who in your business can access the workspace and with what role. You are responsible for what they do.
  • We may ask for information to verify your business before or after activation.

4. Fees, activation and the wallet

Creating an account is free. Connecting a WhatsApp number and sending messages are unlocked by a one-time activation fee of ₹5,000 plus GST. After activation you add prepaid credit to a wallet and each message you send is charged to it at the rate for its category. All prices are in Indian Rupees (INR) and are shown on our Pricing page. GST at 18% is added at checkout to the activation fee and to each wallet top-up; only the amount you add, before GST, is credited to your wallet.

Payments are processed by our payment provider. We do not see or store your card, UPI or bank details. A top-up can be between ₹500 and ₹50,000.

The wallet is prepaid credit for messages sent through SandeshWA only. It cannot be withdrawn as cash, transferred to another account or used to pay anyone else. The activation fee is not added to your wallet.

Our prices are separate from any charges WhatsApp/Meta makes to you. Where you connect your own WhatsApp Business Account, Meta may bill that account directly. We may change our prices for the future with notice on the Pricing page; a change does not affect messages already sent.

5. Using WhatsApp through the platform

SandeshWA sends messages through the WhatsApp Business Platform, which is provided by Meta. You must follow Meta's terms and the WhatsApp Business Messaging Policy, and our WhatsApp messaging policy. Meta may approve or reject your templates, limit your sending, change its prices or rules, or restrict your number. We do not control these decisions and are not responsible for them.

  • You must have a valid opt-in (consent) from every person you message, and keep a record of it.
  • You must honour every opt-out. Do not message people who have asked to stop.
  • Business-initiated messages must use templates approved by WhatsApp, in the correct category.
  • We do not guarantee that any message will be delivered or read. Delivery depends on WhatsApp, the recipient's device and network.

6. Acceptable use

You must not use the service to:

  • message people who have not agreed to hear from you, or use lists that were bought, scraped or obtained without consent
  • send content that is unlawful, misleading, harassing, hateful, sexually explicit, or that promotes gambling, tobacco, weapons or other things WhatsApp prohibits
  • impersonate another person or business, or hide who you are
  • attempt to access other customers' data, disrupt the service, or bypass limits or security
  • resell the service without our written agreement

7. Your data and your customers' data

You keep ownership of the contacts, templates and content you put into SandeshWA. You give us permission to process them only to provide the service to you. For the personal data of the people you message, you decide why and how it is used and you must have the right to use it; we handle it on your behalf. Our Privacy Policy explains what we collect and how we protect it.

8. Availability and changes to the service

We work to keep the service available but do not promise it will be uninterrupted or error-free. We may improve, change or remove features, and will give reasonable notice of a change that materially reduces what you paid for.

9. Third-party services

SandeshWA relies on third parties, including Meta (WhatsApp), our payment provider, and hosting and database providers. We are not responsible for their acts or outages, though we will help you where we can.

10. Intellectual property

SandeshWA, its software, design and branding belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the service while your account is active. Nothing in these terms transfers any of our intellectual property to you.

11. Suspension and ending

  • You may stop using the service at any time and may ask us to close your account.
  • We may suspend or close an account, with notice where practicable, if you break these terms or WhatsApp's rules, if we are required to by law or by Meta, or if your use puts other customers or the service at risk.
  • When an account is closed, what happens to unused wallet balance is set out in the Refunds & Cancellations page.

12. Disclaimers and limits on our liability

The service is provided as it is. To the fullest extent the law allows, we do not give warranties beyond those in these terms, and we are not liable for indirect or consequential loss, or loss of profit, revenue, goodwill or data.

Our total liability to you for any claim arising from the service is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

13. Your responsibility for your messages

You are responsible for the content of your messages and for having the right to send them. You agree to compensate us for loss, claims or penalties that arise from your breach of these terms, WhatsApp's rules or the law.

14. Governing law and disputes

These terms are governed by the laws of India. We will first try to resolve any dispute in good faith through the contact details on our Contact Us page. If that fails, the courts at the place of our registered office, stated on the Contact Us page, have exclusive jurisdiction.

15. Changes to these terms

We may update these terms. The date at the top shows when they were last changed. If a change is material we will tell you by email or in the app. Continuing to use the service after a change means you accept it.
